From 1 January 2023 amendments to the Civil Code entered into force, providing for the possibility of divorce at a notary, i.e. without going to court.

At a notary, a marriage can be terminated by mutual consent of the spouses, if:

  • more than one year has passed since the marriage;
  • both spouses have concluded an agreement on the consequences of the termination of marriage;
  • both spouses have the necessary capacity;
  • spouses do not manage a joint household and do not live the spouse life for more than a year, and
  • have no common minor children.

When terminating a marriage by notarial procedure, it is necessary to inform the creditors of the spouses and send a draft of the agreement on the consequences of the termination of marriage, as well as the contact details of the notary.

The marriage is considered terminated from the date of entry into force of the notarised agreement on the consequences of the termination of marriage.
